How Foreclosure Works in Mississippi

Knowing the actual timeline is what turns panic into a plan.

Mississippi permits both judicial and non-judicial foreclosure, and lenders almost always choose non-judicial because it is faster and cheaper — it does not require a lawsuit. The process is governed by Miss. Code § 89-1-55.

Here is the sequence, in plain terms:

  1. You fall behind. Under federal servicing rules, a servicer generally cannot formally begin foreclosure until you are more than 120 days delinquent. Most deeds of trust also require a 30-day breach letter before the loan is accelerated.
  2. Notice of sale. The lender must publish notice for three consecutive weeks and post notice on the courthouse door.
  3. The sale. The property is auctioned. And then it is over — Mississippi provides no post-sale redemption period after a non-judicial foreclosure.

There is one more piece worth knowing: under Miss. Code § 15-1-23, a lender can pursue a deficiency judgment against you for the shortfall if it files suit within one year of the sale. Losing the house does not automatically end the debt.

Why Selling Before the Sale Date Helps

Three concrete advantages to acting while you still control the outcome.

Offer in 24 Hours

When there is a sale date on the calendar, speed is the whole game. We can look at the house and give you a number the next day.

Keep Any Equity

If the house is worth more than the payoff, a sale puts that difference in your hands. A foreclosure auction rarely does.

Close the Deficiency Risk

Paying off the loan through a sale removes the one-year window a lender has to come after you for a shortfall.

Foreclosure Questions, Answered

How quickly does foreclosure move in Mississippi?
Faster than most states. Lenders here typically use the non-judicial process under Miss. Code § 89-1-55, which does not require going to court. Once started, the lender publishes a notice of sale for three consecutive weeks and posts notice on the courthouse door, then sells. Federal rules generally bar a servicer from formally starting foreclosure until you are more than 120 days delinquent — that 120-day window is the time you have to act.
Can I get my house back after the foreclosure sale?
No. Mississippi does not provide a post-sale redemption period after a non-judicial foreclosure. Once the sale happens, it is final. This is the single biggest reason to act before the sale date rather than after.
Could I still owe money after losing the house?
Possibly. Mississippi allows a lender to pursue a deficiency judgment for the shortfall if it files a separate lawsuit within one year of the sale. Selling before foreclosure and paying off the loan is how you avoid that exposure.
Can you close before my sale date?
Often, yes — we can close in as few as 7 days. Call us with the sale date and the lender's payoff figure and we will tell you honestly whether the timeline works. If it does not, we will say so rather than string you along.
What if I owe more than the house is worth?
Then a cash sale may not clear the loan on its own, and we will tell you that immediately. Depending on the lender, a short sale or a loan modification may serve you better. We would rather point you somewhere useful than waste your time.
Is it too late if I already got a notice?
Not necessarily. Until the sale actually happens there is usually still room to move. Call (601) 205-6007 with the notice in hand and we will walk through the dates with you.
